I upgraded my desktop hardware and decided to move up to windows 7 professional. I found a retail version on Amazon for 244 dollars advertised as new. I received the software today and the seal was broken on the package (although it had a "New" sticker on the front of the case).

I don't mind it if the software was opened previously but I am not going to keep it if the product activation key has been used previously. I feel that 1) The seller would have used deceptive selling practices if it HAD been used and sold it as new. 2) I don't want to mess around with phone activations or risking future problems if someone else is using the same product key.

I guess if it doesn't activate automatically over the internet it means it has been used before? Should I even bother with it and just send it back to Amazon for a refund?

Found this:

regarding your question if a Microsoft website could tell you if your Product Key has been used by somebody else or not yet, you will have to install the Operating System first. Once installed, go to the link below and click on the "VALIDATE" link: About genuine Windows - Microsoft Windows

Thanks Tek_Freek,
I guess if it doesn't activate correctly I should just send it back to amazon. I am kind of disappointed that the seller didn't clearly state the box had been opened but with Amazon I know I will have no problem returning it. (Unless the seller trys to claim the box was sealed)

It might still be good but you could have gotten it for much cheaper:

Windows 7 Professional

I would send a message to Amazon (I think you can do so on the page that has your order on it) and let them know what you found. See what they have to say about it.

Yes, it looks like I could have saved 100 bucks Oh well, it is too late to do anything about it now. I installed last night and everything went according to plan.
