I ordered a Sony camera (ship to store) and when unboxing it I noticed the screen is massively smudged and the battery is charged already.

Dies Sony actually ship cameras with the battery already charged and no protective film on the screen or has this camera been either returned or otherwise used. I'm not familier with Sony products and this wasn't an inexpensive camera so I really don't want a returned item at full price.

Sony doesn't seal their boxes with tape or a sticker so it wouldn't be obvious in that respect if the box had been opened.

Could a mod please move this to consumer electronics as it would be more appropriate there.

Check the file names, there is internal counter. AFAIK the first file should be something like XXX0001.jpg, next one will be XXX0002.jpg. XXX could be anything. Note the internal counter can be reset.

If it shipped with memory card something else you do is run some file recovery software on it. If they just did format the files should be still there. If it finds some pictures on it..... Note if you don't find anything that doesn't necessarily mean it wasn't used. Memory cards can be wiped, this is different than formatting.

My Sony NEX came with a partially charged battery, but the film on the screen (and no smudges) too. I'd say someone played with yours beforehand...
