Rocketfish Headphone RF-WHP212-A Can't turn headphones on (turn on, blinks)

I bought a Rocketfish Headphones on Ebay RF-WHP212-A.

I'm sure I'll need help setting them up with the TV
but
My problem now is that
I can't turn the headphones on.

I charged the headphones and the base said they were fully charged.

The instructions state the following:

"Slide the POWER switch on the left earpice to turn on the headphones.
The POWER/PAIRING indicator on headphone blinks (blue)."

The problem is

a. when I push the power swith over, it snaps back to where it was before.

b. is that correct?

c. or should it lock into place when I push the power button towards the arrow?

d. any thoughts?
