Most European countries have laws against incest between lineal ancestors/descendants, and between full siblings. However, in most countries these laws are no longer enforced if the incest takes place between consenting adults.

Napoleon abolished incest laws in France and Belgium. Incest had been legal in these two countries. On 27 January 2010, France reinstated laws against incest, which had been thrown out during the French revolution as a "religious taboo" over 200 years prior. The new law, however, defines incest as rape or sexual abuse on a minor "by a relative or any other person having lawful or de facto authority over the victim". Incest between consenting adults is not prohibited.

In many other countries incest is no longer a punishable crime although official marriage may not be allowed.

My point?

At this juncture in time it would seem logical to deny the criminal aspect of incest as a vestigial taboo from a prior age.

In fact, as the taboo against out-of-wedlock birth and homosexual acts dissolve into obscurity it would seem logical, by extension, to void the proscriptions against these sexual acts as well. Whether they contribute to inferior offspring hardly matters as we now understand that many factors, like genetics, age of the mother at conception, proximity to harmful natural phenomena, etc., play as great, if not greater a role in determining the health and viability of offspring.

Are we to interfere in these matters "for the good of society" as well?

The falure to sustain lineage thru the restrictive covenants of marriage, or to control coitus between adults who may very well be closely related thru unknown parentage (adoption, infidelity, promiscuity, et al.) has likely resulted in more "incest" than one who opposes it would care to contemplate.
But I have a feeling that it is not the result of the act, but the act itself, that is most rabidly opposed.

Criminalizing the rare "obvious" cases are a waste of time and money and do nothing to diminish the reality that we, as a society, have lost control of this aspect of human behaviour, if indeed we ever really controlled it at all.

Why aren't the interbreeding royal families of the world, held to the same standard? Also, I find it funny that most of the people calling this disgusting, will watch some royal wedding and think it is so fantastic and beautiful. Hypocrites

In most countries, the cops would have far more important things to worry about what two consenting adults do for entertainment in their spare time. In America, the only surprising aspect of this case is that President Obama hasn't (yet) weighed in on the subject.
