The 1st Amendment doesn't apply to most private sector employees despite you thinking that it should. It doesn't. If I went around trashing gay marriage or saying we should round up this or that ethnic group, I could get fired for it because I work in the private sector and I'm not in a union.

I'm personally glad she got fired because now I don't have to boycott Subway.

People get fired for saying crass things all the time. Like that guy who filmed himself harassing a Chik-Fil-A drive-up worker because he didn't like the CEO's politics. And I recall comerdian Gilbert Godfried got fired as the AFLAC duck's voice because he said something bad about Obama. The real world.

Byron, 1st amendment prohibits government only from restricting your words.

As for employment, Employment At Will allows either side to end the working relationship. For any reason that would not violate EEOC laws. Being a crass idiot, unfortunately for this ex sandwich artist, is not a protected employee class.
