As I said, it doesn't matter who owns the phone itself. You don't own the Software. You are licensed to use it, period. Read your agreements. Just because you buy a Computer, for instance, with Microsoft windows on it, does not make you the owner of that Program. Microsoft still owns it, and all you have is permission to use it. and its protected by a license key. You can sell your Computer or it can change owners a dozen times, but the software always is owned by the creator.
Everyone has their own "View" on this, and the ones that are against Apple are the ones that have the least knowledge about what the Government is "Really" asking for, and what the implications are, (Worldwide also) and what can happen if they attempt this. This is one Box that should not be opened.
It makes all the Appelites warm and fuzzy believing the phone cant be unlocked or that it would take a lot of resources to build a key. They have it. They just dont want you to know about it.
If government asked a local craftsman around here to come to the aid of his country to top terrorism by opening a door or build a key...there would be a fight to see who would be first in line to do it for free.
Thank goodness there are companies out there that continue to look out for 'we the people'. Please stop trying to hand everyone's rights over to the gov't on a silver platter.

I am asserting that you are under the influence of the Kool Aid. Apple cares about Apple which is money. They don't care about you or your rights. It just so happens that this charade makes them look like they do.
The owner of the Software is Apple. They aren't dead either. Show us a copy of the sales agreement from Apple to the Government Agency that wants it. They own the Phone, and they already have what they own and paid for. Your grasping at straws now.
No, Boris. Someone is not grasping at straws just because you don't agree with them.
The last few years before retiring, all the principals were required to use a Blackberry and carry it at all times, even when off work. The Blackberries belonged to the school system and returned to the school system at the end of employment. The system had rules as to how they should be used and how they could not be used. While limited private use was acceptable, it was recommended that we have primarily use our privately owned phones for personal business and socializing.
Listen, Apple is a scummy company. Apple employs slave children to make their phones, paying them pennies per hour, where those children work in terrible conditions.
Apple doesn't pay taxes in the US so that it can make money for its wall street friends.
Apple represents whats wrong with America, so does it surprise anyone that it sides with terrorists?

I'm not naive enough to assume they are ONLY doing this for their customers, but to say they are only doing it for themselves is false.
I do genuinely believe that Apple DOES care for its customers and their privacy.

Apple may not be the best company in this regard, but they do attempt to shut down the child labor from their suppliers.
Regarding the Amnesty International report, Apple issued a statement to the BBC. The company reaffirmed that it has a zero-tolerance policy when it comes to the use of child labor in its supply chain. Apple says it is currently investigating the claims against its cobalt supplier.
“Underage labour is never tolerated in our supply chain and we are proud to have led the industry in pioneering new safeguards. We are currently evaluating dozens of different materials, including cobalt, in order to identify labour and environmental risks as well as opportunities for Apple to bring about effective, scalable and sustainable change.”
When a supplier is found to be violating child labor laws, Apple forces it to perform the following tasks:
fund the worker’s safe return home
finance the worker’s education at a school chosen by the worker or his/her family
continue to pay the worker’s wages
offer him or her a job when he or she reaches legal age to work.
