We should get what we pay for, so I won't call this a frivolous lawsuit. However, it seems rediculous that our courts have to deal with these issues.

Yay or nay?

Per the article...."It comes down to this: On the menu, a hamburger at Micky D's is cheaper than a cheeseburger".

There used to be a separate Quarter Pounder and Quarter Pounder with cheese, but that hasn't been the case for several years. You can have them serve it without the cheese, but no, I don't think you should get a discount for doing so. And $5 Million in damages? They must have ordered an awful lot of sandwiches to need to recoup that extra $.20-$.30 they paid each time for their unwanted cheese.

sometimes I wish Ronald McDonald would punch one of these ungrateful SOBs right in the mush. Not because I disagree with their claims, it's just that I like to see a good old fashioned clown brawl.

How in the WORLD is this different from asking for a hamburger but no tomatoes, please. Or no onions please. Or no mayo please.

People aren't screaming that they're being forced to pay for tomatoes, onions or mayo they don't want.

You ask that some item on the menu be made for you without one of the ingredients, (in this case cheese) you don't get a break in price.

Exactly. Development of the point of sale software and training employees to use it to allow custom orders wasn't free. Also, with more customization come more errors (food thrown away and re-made and the associated cost). If people didn't like the price they should have cancelled their order and walked to another restaurant.

Really? Seems like the simple solution would be for McDonalds to simply say "we no longer offer those items (plain quarter pounder whatevers) on our in-store menu, however our customers are free to customize our current offerings at no extra charge".
Clown brawl, I'm down for that!
