i need to see a little bit earlier than the throwing of the shake. the manager cant just get physical over someone saying mean things. she looked like she may have been on her way to attack the girl before the drink was thrown. if so, felony on the part of the employee. but im not sure without seeing some more.

Check out the Daily Mail link someone posted a few pages ago. They actually have a transcript of the dialogue leading up to the tussle.

At my work, there were two employees at the store next door who followed a shoplifter out the door and one of them attacked and punched the guy. The management of our store IMMEDIATELY held a store meeting and they told everyone that if this ever happens at our store, let the perp get away and call the cops. They could not stress enough that we are NOT to engage anyone, and we would be terminated if we did.

Businesses have to protect themselves against lawsuits, and they do not consider a 3 cent soda drink, or even a $1,000 TV worth the risk of being sued and the bad press that would ensue. Like I said earlier, strictly business, nothing personal.

But what if the shoplifters threw stuff at you and hit you with an item? Were you advised to just take it?

The point of letting them steal is shoplifters usually just want to shoplift. They won't escalate to violence unless confronted. If a person goes into a convenience store and steals a soda or a pack of gum, they're not going to grab a bottle of beer and just throw it at the cashier on the way out for no reason (usually). Unless they're after what's in the register, they just want to steal a pack of gum and leave. So you let them steal the pack of gum and leave. Nothing wrong with confronting them but from the business's perspective it's often not worthwhile and it's just easier to let them steal what they want and go away than try and detain them or prevent the theft. It's up to the business to make that decision and then train their employees how to react. Working for a retail pharmacy chain we just let people steal. If we had someone that worked security on site at the time we reported it and let them steal. Security dealt with it after that. Often times they just let them steal. They'd interfere if the person wasn't leaving, was stealing larger amounts of merchandise, or was repeatedly stealing. If someone just came in and stole a soda and stuffed a bag of chips in their pants and left, so be it.

I can recall Home Depot fired 2 long time employees for leaving the store to go after a shoplifter...I believe it happening in Ohio but not certain on that being the state or not.

One of my local supermarkets had a policy where store security ( a guy slowly pushing a shopping cart around with non perishable items in it to appear like a shopper ) was to only attempt to detain a shoplifter in the store or at the exit...and not to follow into the parking lot if they made it out of the store......but one security guy followed a woman outside and she got into her car and he continued to try to stop her and she backed up hitting him and drove over both his legs and took off....she was later apprehended by police..

And at that same supermarket a store assistant manager saw a guy take something and than run out the exit door...the manager gave chase into the parking lot and the guy saw him chasing him so he ran out of the huge parking lot and crossed a busy highway and the manager kept chasing him and even attempted to cross the highway as well and got hit by a car....was badly injured and was never able to return to his job....and this highway was a good 500' from the exit door....stupid decision but the adrenaline gets rushing and common sense goes out the door as well.....look at road rage...what use to be just giving or getting the finger and at times fist a cuffs has today in many cases escalated to stabbings and shootings.......just crazy today.
