Apparently this guy was 'stealing' by returning packages filled with junk and taped up to look like they were never opened. Probably selling the contents for a profit. Doubt a judge would buy into the kleptomania excuse.

If you get caught stealing from kmart you must be a horrible thief. I can't imagine a store that would be easier to steal from or care less.

Ive mentioned this before in other threads and it may sound crazy, but in our stores (gas station/convenience store chain), it really depends on what products are stolen, that determines the loss (if any) to the store, cigarettes, for example, the way our contract is written with the individual cigarette companies, we do not loose any money off stolen cigarettes, the companies eat ALL of that.

Its the same in our contracts with snack, candy vendors as well, we have alot of people shoplifting candy bars, chips, etc, but we do not loose any money off this at all, and really the loss to the vendors is negligible, markup on those items is ridiculous.

Right before I was hired as a Field marketing coordinator, the chain did a study on the cost of shoplifting to the company, and surprisingly they found in total, it did not impact P&L as much as it was thought to, of course, this led to the company changing their policy on dealing with shoplifters, all the store mgmt can do is ask them to leave the store and refuse to serve them if they come back, not allowed to involve police anymore though.

I'm sure they'll let him get away with it. Ya'll know if it was a regular joe they'd throw the book at them...make them pay restitutions, fines, maybe even some kind of mandatory BS classes etc.

We had a relative that worked at a Kmart part time for several years in the greater LA area. According to her they were told to just ignore most of the petty stealing in the stores. Just wasn't worth the effort. Store employees getting verbally and physically abused. Slow police responses and thieves out the door and away before law enforcement arrived. Just wrote off theft losses as an operating expense.
