There should be no jail for him. Or any one else.
I think a better comparison would be someone spreading typhus, or ebola, etc. We don't get mad at them for having the disease, we do remove them from general society to keep them from putting others at risk. To me that is the point of jail, not 'punishing' someone.

Doesn't that also mean they 'choose' to accept society's judgement and any repercussions for that choice?

Might have been ...guy is from the Somalian community which wasn't mentioned in any of the reports and he has a long history of violence

Nah, just a dislike crime.

Seriously, to fit the definition of a hate crime, the victim has to have been selected by the assailant based on his animosity for people of a particular race, gender, sexual orientation, etc.

Given no evidence of that, I suspect the kid was just a handy outlet for this man's uncontrollable rage.

His GoFundMe page has an update from yesterday.

No real changes, but the child is resting comfortably and they're awaiting lab results.

As of yesterday, the family was continuing to ask for prayer, and money. Their statement: "Landen's condition is again the same as similar to previous days, another peaceful night of sleep - small steps towards the healing process. Each new day is a good day. Landen's recovery is expected to be ongoing for a long time".

It sounds to me like the boy is in a coma.

New update today:

We have good news to share with you all on this Good Friday! Our miracle child Landen is showing real signs or recovery. New test results have been positive, though he remains in intensive care with a long road ahead
