I feel very ambivalent. I think we're on a VERY slippery slope when we make men criminally responsible for bad decisions women make. When one of the partners in a sex act passes out because he/she has knowingly gotten him/herself drunk, the other partner in the sex act should not suddenly become a felon. And that's what happened here, in my opinion.

Men also make horrible decisions they greatly regret when they are drunk. This is such a common story. A man goes into a strip bar (or a hotel bar, on a business trip), gets completely loaded and then later greatly regrets a sex act with a sex worker that he may or may not have had. He has vague memories of a possible sex act, and symptoms of an STD. And now he has to go home to his wife or girlfriend and he doesn't know what to do - tell her, or don't tell her? And in that case, no one - no one - has any empathy for the man's position although it's the exact same position, in mirror reverse, of this woman's position. Minus, of course, the two bicyclists riding by and witnessing what happened and rescuing her in the most humiliating position she's maybe ever been in.

In my opinion, what happened to her was a "teachable moment" as they say, and not a crime on anyone's part. She passed out during a sex act and he didn't notice. It was not a shining hour for either of them, how terribly vulgar, but we have decided to infanticize women and decide they can't consent to getting themselves drunk and consent to drunk sex.

If anyone is drunk and passed out and not hurting anyone or likely to hurt anyone (not behind the wheel) it is absolutely a crime to victimize that person.

This is no different than getting raped by a dentist or dr when you are under for a procedure.

Absolutely nothing teachable about this. He was an predatory opportunist. He had been accused by another girl days before this happened. Emily was already passed out.
And yea sure, if she was drunk and driving she would be held accountable. But she wasn't.

I really don't understand that viewpoint. This is nothing at all like getting raped by a dentist or doctor while drugged under their care.

And yet, as a society, a segment of us have adopted that narrative. And another segment are bullied into not disagreeing.

The two scenarios are as different as night and day. Why do we see this so very differently?

Are you kidding? A female passed out cannot give consent. And it's her fault? No wonder women don't report being raped. This guy saw an opportunity and took advantage of the situation and got caught. The fact that the victim was so drunk that she doesn't remember being raped isn't a factor here. She was raped. It happened behind a dumpster if I remember correctly and Mr. Turner took advantage of a situation. End of story as far as I'm concern.

She's a pathological liar. Her statement went on and on about how she was found behind a dumpster, but there was no dumpster anywhere in the vicinity. The incident occurred next to a basketball court. Then she told the probation department that Turner didn't need to be locked up. Then when the judge gave him a short jail sentence she objected and claimed she never said that. She's nothing but a promiscuous drunk. There is plenty of reasonable doubt in this case. The story was fake news. There was no dumpster, she was not unconscious and no rape occurred. Turner also did not get a light sentence - he got life on the sex offender registry.

Penetration without consent regardless of if it is an object or a person's "appendage" is still rape.

ClaraC - you don't understand why we disagree but what is the difference btw being passed out and raped and under anesthisia and raped? One deserves it for beomg a woman who parties?
