Ok, so basically what i'm trying to find out is....My fiance and I, are trying to get approved for a new apartment. The apt leasers, told us that we were denied approval due to his criminal history. My fiance had a minor possession charge back in 2008 when he was also a minor and it was dismissed. So, they told us to get some documentation on this charge to prove this case has been dismissed. We got them the documentation off the Dallas County web site and emailed it to them.. later on, they contacted me and advised me since I sent the dismissal paper that shows it was dismissed they say since its still on my "record". In order to approve us we would have to pay an extra "security deposit" in oder to move in as scheduled. which is 2x rent on move in.

wtf? this doesnt sound right... I was under the impression only if u had bad credit this could happen... not criminal history.. esp if the case was dismissed!

Here's a link to the Fair Credit Reporting Act. It will detail your rights with regards to consumer reports, including criminal backgrounds. Technically, a dismissed case should NEVER be held against someone. An apartment complex may not understand the difference between a dismissed case and a conviction...

Criminal history can affect an apartment rental. I know of a specific case that happened to someone when he was a minor and now 15+ years later, he was still not accepted. :/ A dismissed case though I would think would be a little different.
