Hi, has anyone heard of a rear set back issue with KHOV and American Legend homes in the new phase of the Heights at West Ridge community in Mckinney? I got an email the other day about construction delay in this community's new phase due to a rear set back issue, which has something to do with the rear setback to be 25 feet rather than the planned 20 feet. Per the email, this issue is to be put to vote in September 2014 with the city's planning and zoning commission. I am wondering if the city is likely to approve this variance. Anyone else facing the same issue? Any information is really appreciated.

This is very rare and usually well defined before they create the subdivision. I doubt you'll get anyone here who has experience.

If the streets are not in they will have to make bigger lots. Bigger lots will mean higher prices.

If the streets are already in they will have to build smaller homes.

Well, the email said something about this new phase being assigned to commercial development before and now being changed to residential. I am just wondering if anyone else who signed up for a home in this community is facing the same issue. I am being given the option to pull out but since the price is locked, i want to tread carefully and not lose the home, if i can. I spent two months researching the area and looking for homes in my budget. I have to start all over again and i am so disappointed with this development.

I would stick it out. Prices have gone up and you probably will pay more for the same house today.

I think it was resolved and my friend closed the house in december.
