my name is on Deed of Trust we're near closing title docs do not include (nor has ANY paperwork or contract of sale thus far) my name as a seller owner nothing mortgage company verified I am an owner I have original paperwork including deed I am not on mortgage but am on deed and considered owner also referenced throughout as spouse when not by name can current realtor who is employed for the selling of our home not include my name on any document since I am a legal owner?

Don't quite understand the situation here. Are you saying you and your spouse are named as owners of a house you're selling, and there is a mortgage on this house but your name is not on the mortgage? But your name is on the deed to the house?

And now you have retained a realtor to sell the house but none of the documents between you and your spouse and the realtor reference you as an owner?

Do you have a potential sale? Has a sales contract offer been presented to you? If so, is your name not on the contract as one of the Sellers?

(Just trying to understand the situation)

You know, they put punctuation marks on keyboards for a reason. If it were possible to figure out what you're saying, it may be possible to answer what I believe is a question.

LeagleEagleDFW I appreciate the thought I do believe you can comprehend the statement without the proper punctuation I am truly sorry it bothers you that I would rather not flip between 2 keyboard screens in order to type in a cell phone that doesn't make me IGNORANT nor does it reflect on my capabilities I don't mind my lazy writing in this context due to the lack of formality I find it hard to believe you care to help given the nature and I suspect motive for your comment since it was drenched in unprovoked malice I hope you know you are a smart person and breaking others down isn't necessary to prove it ... have a good day though and thank you for your pennies worth...

If anyone does know if this is normal or if it is being handled improperly and to what degree I would appreciate the insight I've repeatedly asked the realtor without receiving a clear answer or even a second of consideration it feels as if it is being handled wrong by my realtor but I am a first time property seller and not certain what regulations or requirements pertain to this situation ...any information would be amazing... thank you for your time

It does not matter who's name is on the Loan. Both your names are on the deed and you both will need to go to closing and sign paperwork.

Any checks that are cut after closing will have both your names. Are you concerned you are not getting your half of the money ?

Why do you care that your name is on the paperwork? And by the way, I agree with Rakin that if you are on the deed you have to go to close and sign and cannot "conceal" your name unless you own it as a LLC or some other means.

If you are on the deed, your name should have been on the contract to sell.
