I gave $10000 earnest money to Grand Homes and then I found out some internet research about power lines and EMF (this house is close to power lines) and so I decided not to buy the house, and so the very next day I went back to get it back. He said he will return the file to me, but now he is refusing to give it back.

He has even cashed the cheque. Now its been over 10 days.

What do I do ?

First of all....let me just say...that even with a new home ..this is why it is a good idea to have a Real Estate Professional represent your interest. However...I do believe you have recourse....you can go to the Dallas County Realtor Board or whatever county you signed the contract in and request mediation. Did you put down option money? I would call the salesman and tell him that you plan to seek mediation unless your money is returned in a rapid fashion. Look at your contract carefully. You should have put it in writing that you wanted to terminate the contract. Otherwise you have no proof.

I learnt it the hard way that we definitely need to work with a buyer's agent. Its free to the buyer but really proves its value in situations like this. Read this blog about the builder

frankly anyone who buys a spec home from a tract builder W/O THEIR agent is like a sheep to the slaughter and they better have an agent who has a little wolf in her/him as well

It's not "free" to use a buyer's agent, especially when buying from a builder. The buyers agent costs you 3%. If you don't have a buyers agent, you can negotiate 3% off of the sales price, without any discussion.

I wonder if the OP got his money back. The lesson he learned is to be careful when you deal with Grand Homes. Their reputation is pretty much on the low end.

I'd appreciate any information on Grand Homes as we're considering legal action. Anybody have any suggestions? The general problem we're having is related to the home's warranty and the fact they won't honor it.
