Hi everyone,
We were driving through Delaware recently & were issued a traffic ticket by the State Police for failure to stay within a single lane. I believe the officer erred in issuing the ticket. How does the appeals process work? Thanks!

You go to court and plead your case.

If you choose not to pay by mail yor will have your chance to come back to Delaware and tell the Judge in traffic court. One word here in a Court appearance there are many added fees not required on mail ins.

How did the officer err, and how will you prove it. You will have to prove it, so you will be wasting your time most likely....unless there is some video proof or something like that.

Hi everyone,
Thanks for your replies. I'm most interested in learning how the court hearing works. Is it very formal or loose? How strictly are the rules of evidence or civil procedure enforced? what types of fees are imposed? How much are they?

Call the clerk of Court in that county, they are obliged to help you in re civil procedure, forms, motions, fees, or they might already have the info on their website !

Come to court and appeal it if you want. Now staying in your lane would be something the police are seriously looking at. Our news very often is reporting fatalities with vehicles running off the road and hitting something or head ons were someone "for unknown reasons" crosses the center line and causes a head on collision .
