My 2 roommates and I moved out of a house in Denver September 1st. We have had former "issues" with our landlords, and now it is November 1st (60 days post move out) and we have not gotten our security deposit back ($2600 or months rent). When I asked Landlord how much we were getting back today, she stated there were a few cleaning fees and some small damages, but the bulk was re-landscaping the back yard from basically dirt because we had 3 dogs that played in the back. She mentioned "your dogs destroyed that back yard and per the lease agreement you are responsible for any and all pet damages". The repairs: "reconditioned the soil, put down sod, and repaired the planter areas" for $1700. There was not sod there previously, and it was not an out of this world landscape to begin with. Is she allowed to landscape however she likes with our security deposit? I'm waiting to see the actual invoice of the landscaping company if she will show me a photo of that.

I need to brush up on the actual lease in terms of what we were accountable for landscape and yard wise.

We have some "after" photos, but I asked her for photos of the "damaged" areas as well.

If the 60 days past before contact was made, I would consult an attorney to review your options.

was there significantly more grass than dirt when you moved in? Was the condition of the lawn included on a 'move in checklist' that you and the landlord signed off on?


I would pay special attention to the deposit return terms section of your lease, as well as your responsibilities for lawn maint.

Most security deposits must be returned within 30 days unless your lease says otherwise and the county where the property is hasn't allowed for longer.

Isn't it 60 days that the landlord has to return your deposit by law in the state of Colorado? Unless, it explicitly states in the lease that the deposit will be returned in 30 days.

Also, I have heard that if your landlord does not return your deposit and doesn't have just cause in keeping it you can sue them in court for 3 times the amount of your deposit.
