I'm the one that always lets Caesar out in the morning and at night, and at other various times of day.
Unless he's been out close to when I go to bed, (which can be as early as 11pm or as late as 2am if I fall
asleep in the family room) he goes out one last time before I go to bed. Sometimes he wants to go to bed
earlier, by himself, so he goes and gets in his kennel in our bedroom. After letting him out in the morning
I put him in bed with us.

Arrrggg!!!
this really shouldn't be an issue for Einstein as long as his 'Dad' walks him long enough to do his business and then doesn't give him access to any treats or water until morning. We have always kept our dogs
on strict feeding schedules in order to accomodate our work schedules. They're (we're) out until they poop.
We've had no problems.
