If a homeowner leaves her dogs in the care of a housekeeper and the plumber gets bitten, is the homeowner or the housekeeper considered liable?

I'm going to guess here - the homeowner. It's their property and their responsibility for securing it and making it safe, not leaving it to someone else to do. I would think the housekeeper has a legitimate argument that these are not her dogs and she didn't know [i]how[i] to control them. It's also the homeowner, no doubt, that will be reported for the bite and will be responsible for quarantining or doing whatever it is state law requires...another good argument for crate training.

I'm not a lawyer. And I assume that it happened on your property. If so, than it's the homeowner that's liable. But, the law could be different in your part of town, sooooo, seek legal advice and go from there. Good luck!

Whoever owns the house can be sued. But, most states have a "first bite free" exemption- . Was someone badly injured?

The homeowner--it is their dog, their home. If the housekeeper had the dog at HER home and bit the plumber at HER house it would be her insurance that would be responsible.

I agree. Definately the dog / home owners problem. Dont look for an easy scape route by blaming the housekeeper, she didnt raise the knor would be the primary care giver for the animal.

Thank you for your responses. The dog and house aren't mine. My housekeeper also cleans at the dog owner's house. Her other employer is trying to place the blame on her. I think it's terrible because the owner can afford to pay the plumber's medical bills whereas the housekeeper struggles financially.

I've done some research and discovered it can go either way if it makes it into court. If the homeowner can prove that the housekeeper was a 'keeper' of the dog, and that the housekeeper had prior knowledge that the dog woudl bite, the homeowner really could do this to the poor housekeeper. Apparently pet sitters can be the ones liable. I think that's nuts.

Fortunately, the plumber was not severely harmed. He just had a couple of puncture wounds in the calve.
