Maybe I read it wrong, but I thought she wasn't named as a driver? So the insurance wouldn't have covered her accident.
Okay (paraphrasing) - if she drove a rental rented by someone else, and was not a named or permitted driver under the rental agreement... those are some very deep weeds.

Lawyer. Lawyer lawyer lawyer.
I'd be expecting a second lawsuit from the car rental place.. Though that one would probably be to whoever rented the car.
In fact, I'm surprised that one hasn't already happened.

You're screwed.
a) Why were you driving a car where you were not listed as the driver of, and

OP - take it from Don - a liberal, and myself - a conservative. We don't agree on much of anything -- but we do here. You are screwed. Everyone says get a lawyer -- I'm not sure that makes much sense - you will wind up paying a lawyer big money to be told that you're screwed. Wait until you see how much Allstate is trying to collect.
Can someone rent a car without having car insurance?
Whomever rented the car (since that doesn't appear to be the OP) would have insurance, or the car rental agency would issue insurance.
I think the OP's in a hell of a mess but someone should have coverage for this. Unless it's invalidated by her driving the car without being authorized.

I'm trying to figure out what partisan politics has to do with this situation. At all.
Except that there seems to be an ever-diminishing subset of 'Murricans who can discuss the weather or a dinner entree without parsing it into lib'ral/consurfatoid dialectic...
I think the one that is liable is the person who rented the car. When you rent a car, they ask do you want a 2nd driver on rental agreement.
That is what I would assume. The person who signed the rental agreement is the person responsible for the vehicle. Now if they had insurance that covered rental cars (as I do), they MIGHT have coverage for another licensed driver in the car, rental agreement or not.
You're broke and ain't got nothing anyways? If so they can sue all day long but there's not much they can get.
Depending on your State they might be able to garnish your wages. Maybe not.
Talk to a lawyer though.
