Kay Celine is suing Stein Mart Inc. for copyright infringement and unfair competition.
The Los Angeles-based retailer claims in a suit filed in federal court that Jacksonville, Fla.-based Stein Mart has been knowingly reproducing and selling clothes that feature a Kay Celine design since at least March. Another California-based retailer, Sienna Rose Inc., is also named as a defendant in the suit.
According to the suit, filed in May, a Stein Mart buyer named Barbara visited the Kay Celine sample showroom in New York in December and requested to buy some Kay Celine garments bearing the design.
The buyer’s request was declined, the suit says, because Kay Celine had already sold garments bearing that particular design to major high-end retailers and specialty stores, and therefore could not sell the same design to Stein Mart, a discount retailer.
Kay Celine executives discovered in March that Stein Mart was copying and/or pirating the design, the suit says.
Stein Mart did not return calls seeking comment.
