Looks like the gop will be tripping over themselves in the weeks ahead.

Now this is what you get for making a deal with the devil, when the price is higher than you could possibly imagine, you then find your in a fight with people who you thought were your friends. This might get messy and i'm looking forward how this pans out.

The Tea Party thinks it has found a way for Romney to win after all.. Something about a 2/3rds clause in the 12th amendment to the Constitution. The following was forwarded to us earlier today, and, as far as I (Molly) can tell, it is just plain wrong.

I've been reading and rereading through the 12th amendment, and it appears that a few things in that 12th amendment have been taken out of context by our TP friends.

Here's the scoop: If a President has a majority of the electoral votes cast, he's in. Period.

If a President does NOT have a majority, then the election goes to the House of Representatives, in which case each state has one vote. Two third of the states need to be present for a quorum for such a purpose. If they can't get two thirds of the states together to select someone before Inauguration Day, then the Vice-President will become the President.

All any TP people need to do is to READ the 12th amendment. Yeah, it takes a few minutes, but it really isn't rocket science.

From the 12th amendment:

"... the President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted; -- The person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice..." baton rouge tea party..

There is NOTHING in the 12th amendment about a quorum being necessary to select the President if he/she has the majority of the "whole number of electors appointed". The Romney states can refuse to submit ballots, but if the electors promised to Obama are a majority of the total electors appointed (270), then the President is re-elected-- officially.

So keep this close if your rightie friends and relatives (Thanksgiving next week) start blathering on about boycotting the Electoral College or some such nonsense.
