The IL Board of Elections got it wrong. Here's why...

According to US law at the time of Cruz's birth, it appears he doesn't meet any of the legal requirements for the acquisition of US citizenship at birth.

While Subsection 7 of the 1952 Act Sec 301 may seem to apply to Cruz, his circumstances of birth fails to meet the requirement as Subsections 4 and 5 use different terminology to distinguish two different requirements: "prior to" and "at any time prior to." Subsection 7 uses the terminology "prior to." Cruz's mother was a resident of Canada "prior to" Cruz's birth in Canada. According to Subsection 7, the law on record at the time, "at any time prior to" does not apply to Cruz's mother's case.

It's not surprising that so many people fail to understand this. Look at how many people think Bernie's "Wall Street" tax will only apply to Wall Street and not to them.

What bothers me about this is that either Bernie is an idiot and has no clue that the "Wall Street" tax he proposes will hit Main Street Americans harder than it will hit Wall Street, or he knows that and is lying to the American people and they're stupid enough to believe him.

Me, too. I would never vote for Cruz, but I'd still like clarification from the US Supreme Court.

Agreed. I believe John Jay, while serving his country overseas, when he says he wants his foreign born kid eligible.

Why penalize a family for serving their country abroad?

It's a matter of law, not the Constitution. Cruz's birth circumstances meet none of the requirements in the 1952 Sec 301 law in effect at the time for Cruz to acquire US citizenship at birth.

he is "ex-canadian". he renounced his canadian citizenship in 2014.

Maybe this whole episode shows we have to rethink the "birther" provision of the U.S. Constitution. It may have made sense when a Tory may have stood for election and brought the U.S. back into Britain's fold. That's not much of a threat any more.

Maybe a provision making an exception for Canada, and providing otherwise fifteen years of citizenship and ten years of continuous residence in the U.S. I do think that ALL public officials should have to renounce any dual citizenships for the reason that even a loyal village mayor may have secret information shared with them and they should not have dual loyalty by oath to another sovereign.
