Legal Experts Side With Trump; It Would Be Crazy to Release His Taxes During Audit | LawNewz


“Almost every lawyer will tell you the same thing, when you are under audit, you finish the audit before you release,” he said.

Robert Barnes, a Los Angeles based attorney:

“I see some of my colleagues would tell their clients to release their tax returns to the public during an audit. Ask them to name a single client they actually gave that advice to. I think that would be legal malpractice."

First of all, and most importantly, the IRS is not allowed to show your client’s tax returns to anyone else. Such returns are protected by the privacy laws of section 6103 of Title 26 of the Code. The only way they could do so if your client had a lawyer dumb enough to let you disclose those records publicly. The IRS could then misuse this otherwise private information to make the audit process more difficult at many levels, and could cause problems for other entirely innocent businesses you do business with.


Aaron Nocjar, Washington D.C. based attorney:

"In an audit of a particular tax year, prior tax years can be called into question as well."




The lawyers said Trump’s recent tax returns — the ones the IRS is still auditing — are just extensions of his older returns, because they include “items that are attributable to continuing transactions or activities that were also reported on returns for 2008 and earlier.”

“In this sense, the pending examinations are continuous of prior, closed examinations,” the lawyers wrote.

This gives Trump legal backing for claiming all his returns are being audited, not just those under active examination.

I still don't read anything about why he shouldn't release his taxes during an audit. It's not like the information will tip off the IRS and trigger an audit.

Trump knows what he's doing. He knows how to play the media better then anyone. He knows exactly when to release them.

Trump probably wants to release his return, but is just playing with the media.

Yea well I bet Trump is going to let Hillary mention his tax returns then call her out and ask her to disclose all the people paying money into the Clinton Foundation and ask her to be as open.



I really don't care whats in Trumps personal tax returns however I am interested in the Clinton Foundation simply because the Clinton's are two ex-politicians who are from the looks of it are using their foundation as a tax exempt tax shelter while collecting money via some sort of questionable money pedaling / power influence scam. Truly they are more corrupt than most people care to really know yet these are the sick individuals who get elected each time to server the greater good and represent the people.

PS Trump is no better but he's the lesser of two evils. That and the fact I'd rather support the man buying crooked politicians than the politicians who have sold out.
