Default HELP!! Can CVS Build So Close 2 Homes?

Could anyone tell me how can I find out whether or not the CVS company can build so close behind my home. I was told that there would be a 50 ft buffer between the properties. Not to mention that where they plan to have the building..looks as if they will be IN the subdivision. It will seem as if my house will be part of a plaza. Is there anything that I can do about this??? I welcome any suggestions. TY & GB*
P.S. I live in Marion Oaks (Ocala, FL) Right behind 484.

Call your City's Planning & Zoning Dept.,,,speak to the building dept too. Planning & Zoning should give you a copy of their codes & requirements for building commercial bldgs. These should give setback requirements and what they're expected to do for adjoining residential properties. I know here in PSL they would have to construct a concrete wall as a buffer zone. Look at your survey to be sure where your lot lines are, and measure the distance so you have your facts. It may be better to go in person.

It may be in your best interests to speak to an attorney regarding your rights. You may be able to hold the City liable for devaluation of your property because of their permitting the CVS being built toooo close to your home.

Zoning is a very important aspect of buying a home. If the area near you is zoned commercial, than they very well might have the right to build there. Usually this is planned years in advance and screening and buffering are offered to the adjoining lots. Sorry this is happening to you...

I hadnt thought of my homes value going down. Or that it will be harder to sell my home if I chose to. Had someone mentioned to us..anytime throughout the years that we were paying for this lot..that they were zoning the small area behind our home..commercial..we would have not finished paying it, much less built our dream home on it. Thanks to you..I will be contacting the owner of the lot next door & a lawyer. If the lawyer thinks that something can be done, I hope that we can afford to hire him. Thank you once again.

P.S. I did contact one of those departments & the guy thought it was funny. Too bad I was too upset to think of getting his name & making sure I wrote down the department. You can bet tomorrow Ill be making a few phone calls. He did tell me that it hasnt been approved yet. If anyone is reading this..please pray on our behalf, that this issue is resolved quickly, that these greedy people's plans do not come to pass. GBY all*

Before you spend any money talking to a lawyer, did you look up the lot on the Marion County Property Assessor's site so see what it is zoned? It may still be zoned Residential.

You need to get your entire neighborhood informed and show up at any meetings.

I would hate to have such a think near me.

From what I have heard, companies like Walgreens and CVS can lease a property and build on it, so you could find out who owns the property and add that to the information you hand out. Of course they pay a HUGE amount of money per month to the person they are leasing the land from AND if the company decides to no longer have a CVS there, the building becomes the land owners.
