Yeah, I really didn't think I had much of an option -- I just feel stuck, and not really sure what to do. The thing that bothers me is why landlord 2 can't just wait another week or two until I am able to move in there.. instead of looking for another person, waiting another 2-3 weeks for them to go through the association process, etc etc.

I did sign a lease w/ landlord 2 but was never given keys, and never paid 1st months rent.

Did the landlord give you any paperwork that specifies the terms of the usage of the deposit? Usually, the deposit protects the landlord if something unforeseen happens (eg. you change your mind; you fail to follow time lines, etc.). The deposit is usually refunded only if the potential tenant is a poor credit risk or lies on the rental application... the landlord decides at his discretion.

With the rental application that I utilize, you would have been in violation of the time lines specified. You would forfeit the security deposit, and I could decide whether I want to rent to you. Truthfully, I would probably not choose to rent to you. It appears that you are a tenant who will try to break your lease and/or be late with the rent. Sorry!

Wow-- you shouldn't really assume things about people when you don't know them or know their situations. Honestly, I've never been in this situation before, that's why I was looking for ADVICE, and not for people to JUDGE me.

If you are asking if there is a way that you can get out of the mess that you are in, I'm sorry, but you made legal commitments. You signed papers that are written for the benefit of the landlord, as well it should. He/She has a property that is very valuable. When you violate the terms of the signed contracts, you will be held legally accountable. There really is no way around it and little chance of a loophole that will allow you to abrogate your financial responsibility. What you may not realize, however, is that any potential landlord will almost certainly contact your present landlord(s) before renting to you. You may have additional challenges in your future rental endeavors.

I am not judging you personally, just trying to educate you as to how the entire process works. Good luck!

How do you know that the landlord didn't turn someone else away because the property was already rented to you?
