Default Can a landlord post date a lease

What happens in this case? A person moves in August but landlord never sends lease until October and the lease is dated for October? Can a person refuse to sign it?

You can do what ever you two agree on. Talk to the land lord. If you don't sign it then I guess you could be asked to leave. Have you spoken to the landlord? What is the end date of the lease?

Wink 30 day written notice

Although it does not sound as if you had a written lease in October, the courts in my area would construe your situation as an unwritten "month-to-month" lease. If the terms are not satisfactory in the written lease presented to you, you have the right to move (or he can revoke your right to tenancy). Regardless of which tact either party opts to take, there must be a 30 day written notice given to the other party.

Leases, unlike mortgages, are typically paid "in advance".... therefore it doesn't really make sense to post date a lease agreement.... I would suggest you get something in writing establishing your rights in the home in August.

Question: What type of housing - subsidized or not? This may affect the fine-print and perhaps my ..........
Preliminary answer: Most leases start on the 1st of the month. If you move into a unit mid-month, your lease will probably not start until the 1st.
In the scenario you mention, i.e., a whole 1 1/2-2 months, I would've advised you to cross-out the Oct date, write in the August date - and then sign it.
Contact your regional HUD (Housing and Urban Development) office and/or your regional Fair Housing Administration Office - you can find them online - if you think you were bam-boozled. They are in charge of every rental
property in America - from Aunt Ruth's attic-apartment to the finest condo in FL.
