I've only read to your post, so maybe someone else responded to this, but I don't think the idea was that it's impossible to be a temporary resident. It was that if someone has in fact lived in Florida for years, they are not a temporary resident. I agree.

That's not what "temporary resident" versus just plain old "resident" is about conventionally, however. It's not about one's intentions.

Of course, one can define something however one likes, but we're talking about a conventional use of a term, and that's also how we're using it.

I did not come with him. He came on a Friday and started working on a Monday at a permanent job. He got a TEMPORARY Florida license, but kept this NYS license. He registered his car in Florida. He did not register to vote in Florida. He voted in the 2004 Presidential election in New York by absentee ballot. He rented until May of 2005 and then bought a condo here. He did not Homestead it. He filed and paid New York State taxes for 3 years, from a job that he had in Florida. He used my New York address for both Federal and NY State Taxes. My car and our daughter's cars were both registered in his name in New York. I had a full time job in NY and our daughter went to a SUNY college.

Putting aside his intentions, as you eloquently stated, he should have been considered a Florida resident for 3 years? Both the Federal Government, the State of New York, and even the state of Flordia, apparently didn't think so, since all his legal documents pointed to NYS residency, no matter how long he had been living in this state.

As an aside, when I accepted employment with a Florida school district, I had to sign a loyalty statement. I had to swear allegiance to the USA and the State of Florida. I have no trouble swearing allegiance to the USA, but why should I have to swear allegiance to ANY STATE? I can freely move about from one state to another if I so choose. I never signed any state loyalty oath in New York.

This sounds kind of fishy--is this that person who lived in multiple states for his business?

He misrepresented his residency then. Unless he owns the home, or is on the lease, at YOUR address.

No, ....I do not think it does...as a lifelong resident in NY, I can assure you that no one would WANT to pay NY taxes if they did not have to.

In any event, unless you are a CPA, I would not infer "fishyness".

Anyway....let's return to the original Topic.
