Jimenez spent nearly three years at Martin Memorial before the hospital, backed by a letter from the Guatemalan government, got a Florida judge to OK the transfer to a facility in that country. Gaspar appealed.
But without telling Jimenez's family — and the day after Gaspar filed an emergency request to stop the hospital's plan — Martin Memorial put Jimenez on a $30,000 charter flight home early on July 10, 2003.
Weeks later, Jimenez was released from the Guatemalan hospital and soon wound up in his aging mother's one-room home in a remote mountain village.

Why should the Hospital pay for some one who came here illegal and took a risk to come here the way he did....btw. isn't ilegally entering a country not a felony?

Entering a country illegally is ONLY OK for the people who come here (or anywhere else for that matter) from a communist country such as Cuba, North Korea etc....They can ask for political asylum and have MORE benefits that we citizens have! Oddly enough!
Guatemala is not communist per what I know therefore the guy was purely here illegally.
Now mind you, the Immigration offices here are so backed up that EVEN people who come here LEGALLY are turned into Illegals because the office doesn't move fast enough to process their requests for residency. If this guy had an application pending for residency here, then he should have an Alien number and he can sue them just fine, However if he does not, then the hospital is NOT at fault.
There was an article on Yahoo last month about the immigration office and the FBI not having new and fast enough computers to process applications in a timely manner and how they were back up 3 years worth of applications!!!!!!!!!!! what the article doesn't say is that all tho their computers are not up to date, their credit card and check cashing machines as VERY FAST! as they are very quick to cash checks...and slow as possible to mail a resident card! or work permit for that matter! Total hypocrisy if you ask me!

You make a good point! I have to say I was one time in traffic court as a witness and was waiting and watching all other cases and to my big surprise the judge only told a couple of illegals that they could be deported and he gave them a fine for driving without a drivers license and they could walk out free....I thought ones they are in the court house they would be send back to their country...

Very true, and what's worst is that they actually get away with even more only because jails are already crowded and who's going to pay to "relocate" them back to their country?
Until there will be an immigration office in every state+all major cities in that state, who can actually issue permanent resident cards and the rest of the documents they need, this problem will not be solved.
99.9% of all immigration cases go to California, and California is so packed and backed up it will take years and it will not see any relief.

That is why California is broke and hospitals are closing left and right. We cannot save the world. Heck, we can't even afford health care for our own citizens. Since when should we have to supply it for everyone who comes here?

Update on that Stuart hospital situation. The hospital was found free of wrong doing by a jury of six. Seems the illegal was a day laborer who was a passenger in a stolen vehicle which was involved in an accident. He requested to go home and he was sent back to his native country. Justice was served for all.
