If you were told IT IS occupied by the former owner, you'll would need to wait until they vacate or you evict them,, BUT, if you were only told it COULD BE or MAY BE occupied, you have every right to assume the place is vacant at time of closing and you could legally enter the premise and do whatever you need to do until such time as you find out that the premise is actually occupied.
I was told from the beginning that it was an reo occupied property I gave the previous owner my contact information I will pass by this weekend to make sure the home is vacant if not then I will definitely contact the lawyer I already received the retainer from them so I will hold off till next monday
