Does anyone know of a legal way for a seller to walk away from a short sale with a small amount of cash?

Short sales by legal definition means the seller walks away with zero.

I've been to a couple of short sale homes up for sale. What the owners have done in order to save a little money is to take most of the "light fixtures/fans/windows dressings" or anything no considered attached to the home. That's the easiest legal way to save some money.

Excuse me? Since when are light fixtures, fans, and window dressings NOT considered "attached" to the home? That's crazy.

In CA (and I suspect in the rest of the country) fixtures are considered part of the real estate. Removing light fixtures , woodstoves, and fans would be technically be considered theft. I'd like to see some of the banks file complaints against folks that do this, maybe it would slow a few folks down.

Window coverings, refrigerators, and washer/dryers are considered personal property and could be removed without violating the law.

I have seen HUD give FHA borrowers either $1000 or $750 at closing for their cooperation.

I have also seen lenders give sellers $1500 to not trash the place and steal...oh say...lighting fixtures.
