The portability will never go into effect though. It is being challenged in court. It will probably lead to the whole "Save Our Homes" thing being thrown out. That means people who are paying significanly below their appraised value will probably see their property taxes double or triple next year (or the year after, depending on how long it takes to wind its way through the court system).

Oh. I thought this was all one amendmant and that if it passed then portability did.
Bummer, because the actual amendmant saves nothing in my opinion (what's $200 or $300 per year!).
I was counting on the Portability.
Bummer. I guess it really IS time to leave this area if you want to afford a nice size home, with low taxes, and low home owners insurance.

It is one ammendment but the ammendment states that if one section is struck down by the courts the other sections are not to be affected. The portability is being challenged as a violation of the 14th ammendment. The cynical among us believe it may have been a ploy by politicians to abolish the SOH from the beginning.

I love how they say it's unconstitutional if someone outside of Florida wants to move here but they will pay a higher tax, but it's not unconstitutional if I sell my house and buy another one and pay more taxes than my neighbor, and I already live in Florida. It's amazing how many stupid people there are in the world....

What's going on?
I haven't heard anything about the status of the appeal? Can anyone point me in a direction for information?

Florida may be a relatively conservative state, but it has an extremely liberal supreme court that rarely misses opportunities to strike down things that limit the government's ability to tax you. That's also why, in a state otherwise highly rated as a business-friendly venue, Florida has an out of control civil tort system.
Portability was a sham, but not for the reason you cite. Remember that if the new buyer doesn't have portability (that's most buyers) their taxes will be a lot higher than the seller's. That high tax burden kills liquidity in the housing market because it makes buyers very hesitant to buy. Portability is worthless if you can't sell.
The property tax amendment that we should push, in my opinion, is the 1.35% amendment. It sets the property tax rate on all property at 1.35% of value, versus the 2-2.2% in force now. It eliminates all special and supplemental property taxes in favor of one single tax. It keeps the 3% cap of SOH and adds a 5% cap for all other property. It doesn't authorize any new taxes. It's simple, understandable, and real tax relief. No, I don't work for any politician or political action committee.

voters overwhelmingly approved Amendment 1 to grant added tax relief to property owners. See link: Broward County Property Appraiser's Network
