Here's a mini update on whats happening with the Federal Class action. 100,000 plaintiffs in that one already. Wow. It includes an update from CC homeowner Kampf who testified at the first Senate hearing. He had an interesting idea. He went to the county appraisers office to get his home valued at zero, because it's worthless as is on the market. I suppose his intent is to reduce taxes, because of reduced worth.

Responce from IRS on casuality loss deduction.

Tax deduction may apply to homeowners with Chinese drywall

Like everything else coming from the Feds on this- "We don't know" " Need more testing" blah blah blah, but maybe there will be some recoverable relief that can come from this.

I need help, I just found out I have chinese drywall. My builder Maronda homes came by, because we called them about our ac coil going out for second time in 2 years. George Evans of Maronda homes came and said we have it. Next, he said the will replace the drywall, wiring, hardware, appliances and carpets. Maronda homes will only do this if we sign a medeical release waiver and sign a disclosure. Has to be signed before work gets started. Can someone please tell me if you let your home go into foreclosure, will a judge put a judgement against you. Is the chinese drywall enough to get the judge to understand the situation we are in ! PLease any advice is deeply appreciated and thank you for all of your posts !!!!!!!! MY email address is pinewoodro1983@Yahoo.com PLease any advice - Also need to find a lawyer desperatly thanks

2006 is the year the largest amount was shipped here during the height of a domestic shortage. However, it is being found in homes from 2001-2008. Predomantly the homes it is being found in are 2005 and newer. One Florida investigator says, if the Florida home is a 2005-2006 there is a 50% chance it has it.

Yes, a deficiency judgement can be placed against you even if you have CDW. The banks for the most part don't care about these toxic assets either, or the devasting plight of their customers.

However, if you bank knows the home has it, they may never foreclose on it.

It's rare for banks to go after the deficiency if you just own one home. They realize, if it came to that, there is nothing to go after. However , in Florida they have 21 years or so to exercise it, soo..........

In Florida, banks can not go after your salary or any retirement investments. Know that at least.


A health waiver is total BS and uneforceable by Florida Law. They are hoping people who do not know that, will beleive they can not sue for related health problems. You can, even if you sign that thing. One LARGE builder didn't even bother putting it in, because they know, it wouldn't fly.

Not enough is known yet about the cross contamination of what they will not replace, what a proper protocal is to fully remediate the home of the problem and gaurantee it problem free, nor the ability to sell with a CDW remediation disclosure.

I realize you are faced with very tough decisions and yet many unknowns as is anyone else dealing with this. I hope what little I can give now helps.

I thought the information written in this thread would be enough to catch the big fish to fry them.

Oprah's and Brockovich's source of information would be this thread. And this thread recommends Oprah and Brokovich to help victims of Chinese dry walls? Over-the-counter-drugs to cure a cancer?

With CDW we are not dealing with one plant contaminating the water. We are dealing with layers and layers of corruption and coverups, nationally and internationally.

To turn to Oprah and other entertainers to discuss this issue, we are not reaching the audience that victims would want to have to see the depth of their problem. CDW is not only an environmental problem but also a financial, a political, a judicial and a social one.

Hey, I just found this cruising Topix for the latest on CDW news.

Kudos to you Austingirl for getting the truth of the State Senator out there. Let's hope some other media picks up on it and or someone who might be able to help you, will contact you through it. It makes no sense why he isn't going after his builder like everyone else with it is. There is another story there I suspect.

Anyway, I just wanted to share this. I admire your courage austingirl to stand up for yourself and show others what this "state representative of the people" is really like.

Hi there,

My fiance and I moving to florida in September 2010 (because of my job) but currently we live up in the Boston area. My fiancee works as a carpenter exclusively in the high-end, historic renovation sector but originally trained as plasterer. It is our understanding the the majority of new building and renovations in FL are done with drywall, but with the issue of the chinese drywall is there a market for plastering? I'm not familiar with the drywall vs. plaster debate in Florida but up in the northeast plastering is considered to be far superior to drywall as it is more solid, more soundfproof, more fireproof, and it resists mold/mildew which is important because of our wet winters and humid summers. He also finds that plastered walls are used as a huge selling point in selling a house. I would love to hear some input into the drywall/ plaster industry in Florida, thanks for your help!

FL2010. You might want to start a separate thread about demand for plastering in Florida, in the Florida forum. It would be a shame if this beacon for those curious about or suffering from CDW damages, gets turned into a thread about looking for plaster work, and the advantages of plaster. This is a very serious problem here in Florida and it would be nice if we can keep this one thread, focused on sharing information about CDW.



This may be some good news for those putting their trust in the CPSC. It looks like the Senate Appropriations Committee finally approved a bill to give the CPSC an additional 9.6 mill to help them investigate this problem.

Investigators to get more money for tainted Chinese drywall

This is interesting. So far there are 41 suits filed against Lennar. Looks like they filed a motion to have them dismissed, so they can force their customers to have no choice but sign their onesided repair contract and keep the truth out of the courts and all claims of damages from going before a jury.

According to Florida State law Chapter 558 a homeowner has the right to refuse, a builders proposed offer to do a repair, in the case of a latent hidden defect, which this is, and to sue if they think the offer is inadequate.

If the motion doesn't get denied, that will be VERY interesting.

If anyone reading here has a suit filed against Lennar, you need to know this and find out what your attorney is doing to make sure that motion requestioning a violation of state law in Chap 558 gets denied. I'd call the press, reporting how they want to have the law bent in their favor, to force you to have to take their onesided deal.

Not just Lennar Plaintiffs need to know what they are up to. If a Judge granted the motion, it would set a precedent for all other builders offering lame one sided contracts, to have cases against them dissmissed as well.

Just got back from CC after heading down to examine my home and get a second inspection for Chinese Drywall.
When we purchased our home earlier this year we did not know much, if anything, about the stuff. Thanks to those on this forum (especially HomeStager and yachtcare) we were able to educate ourselves about the drywall and what to look for.
It was frustrating not being able to get to the property to examine it between the purchase time and now due to the long distance.
Upon arrival I removed all the outlets and examined them, all looked newer. No odor or pitted metal anywhere. Checked appliances no soot or blacking on copper or metal. Removed shower valve plates for back of the drywall inspection.
The inspector arrived and told me that I had the house prepped for him properly(even though I did it on my own). In fact, he said that I did half of his work. He reexamined the outlets, checked the coils in the air handler, checked the back of the drywall in various wall locations with a camera, visually checked the attic,
checked water heater and plumbing. No Chinese Drywall observed. We were able to see the names Palatka (FL gypsum producer) and Lafarge North America on the board. I checked out those names on the internet and Palatka is a division of LaFarge North America the largest building supply in North America.
LaFarge has a statement in their site that they have never imported any type of Chinese drywall.
All and all, it looks like we are free of the China Drywall Syndrome.
