This is mainly for the younger crowd, but some first time "older" renters might find it useful also
1. Even if you are capable of packing your own stuff and cleaning, HAVE SOMEBODY HELP YOU DO IT! That is the first step in having "an eyewitness" to how the place was left
2. Use a cell phone video/video camera, or even "still pictures" to show what the place looks like. I recommend the video as opposed to the stills, as the evidence is much stronger should there be any legal issues.
3. If your landlord does not give you an itemized statement within 30 days, and fails to return the security deposit, you have legal recourse! In my state(Ohio) you are entitled to DOUBLE damages for their failure to provide a list/return security deposit.
This leads to my second post in this thread, and you'll see why I wrote this
A landlord decided to evict me for unjust causes. RENT WAS CURRENT and I was NEVER LATE. A couple had their idiotic brother/in law move in and there was an ongoing pattern of harassment.
Landlord stated she needed "police reports" in order to take action. When you live in a town of 38,000 and they are slow as molasses to respond to a lower level call(non emergency), it takes 30-45 minutes on the average. By that time, moron is back in the apartment behaving himself.
LL states that my police calls are baseless and decides to evict me on the basis of the police calls being unjust.
I fight this in the local court, rent is in escrow, but since I'm a HUD recipient, the one year "contract" is considered a month to month and their basis of month to month tenancy is enough to get me out
LL's lawyer decides to refund my escrow to me without question so he doesn't have to deal with me any further. Docket online states "damage" hearing would be within 45 days. Date comes and goes and is not scheduled.
I received a notice to my OLD address(when she knew full well what my NEW address was) stating I tore the place up to the tune of 1500 dollars. Keep in mind THIS APARTMENT was "VACATED" by two bailiffs who told MY ATTORNEY the place was SPOTLESS.
I took an Android video of the place being spotless, and had an eyewitness who helped me clean the place.
I, in turn, take her to court for refund of the security. I come in with my folder and CD and her attorney wants to settle almost immediately.
Amazing how landlords try to run over tenants. I hope this post advises people of their rights, when they are "in the right"
Wow. Good job. Glad it worked out. Had a harassing landlord recently also. People will try anything.
Long story short, ALL of the negative info about their property on Google was actually true. Yeah, it's on the internet, so it must be true? In this case, I should have heeded everything I read.
She was a huge pill head anyhow, and their property taxes weren't getting paid. A new company bought the LLC and she lost her job last fall. Karma.
One day there will be a camera in every cell phone to make this easier...
And pictures/videos are priceless... Sorry you went thru all that.
