Not sure if this should be posted in the state specific threads or not; apologies if this is the incorrect place. I'm just wondering if I will need to have new estate plans written up - will, power of attorney, advanced health care directive, etc - when I move to AZ from CA. I want to make some changes but if I'm going to have to have them redone once I move then I may as well just wait a bit until I move.

Thank you!

Generally, if one is valid in your state, then it is also valid in the new state but it is wise to have lawyer update your docs periodically anyway.

Many of AZ laws are similar to CA laws so there shouldn't be huge differences.

When my mom moved from AZ to TX, we had to completely re-do all of her estate planning, as none of it was valid in TX. (Will, Power of Attorney, Health care POA, Living Will, etc.) When I moved from TX to CA, I had to re-do it, too. TX doesn't have trusts to pass on your home, so we had none there. In TX, probate is required, but it is cheaper than in CA. So now that I am in CA, I had to redo everything. You can check with an attorney as to what is and isn't valid in AZ, but I would imagine that you will have to revise at least part of the package. It is worth paying for a consultation to make sure everything is valid.

You need to have your estate plan checked by an sttorney in the state you moved to, yes.

We did that, and the attorney caught a mistake that could have cost our estate taxes.

But yes. You need to see an attorney in AZ when you move there.

Shouldn't have to but I put my property into a revocable trust and the bank in my new state didn't know what to do with it -- they figured I was incompetent if I had a trust. Took a while to get them up to speed.

Our NY attorney (when we lived there) said if the will was executed properly according to the former state's laws (it was) it wasn't necessary to re-do it. Not sure about POA though.
