We told our landlord that we would be moving in July (which is when our lease was suppose to run out) even though we have yet to see or sign this lease. On March 3rd she said a friend of her's wanted to move back to GA from Nevada and since we were planning to move were we interested in moving the 1st of April, so of course we found a place that the other landlord is willng to hold to the 1st. Now she has texted me and said the lady isn't moving until probably June and that she is sorry she got my hopes up. We have already given a deposit on the other place and really want to move since it's closer to my work. Since we actually DON'T have a lease and she has her 30 days notice, legally can I get my deposit of $600 back? Does ANYONE know the answer to this? Or how I can go about finding out the answer to this question? I would appreciate any help anyone can give me. Thank you.

Best way is to go to State of Ga website and look at the real estate laws regarding leases for the state.I used this site for example to download the lease for rental apts. and never had a problem with anyone understanding what was written. In addition, soewhere in that site or sites dealing with RE laws in the state their are clear guidelines as to "notification" responsibilites on the part off LL and tynant.

Do you have any kind of written agreement regarding the deposit? I'm no expert, but it seems that if there was no lease, then you wouldn't have much protection no matter when you moved out.

It is often difficult to get a deposit back. If the landlord is his holding your money, and does not want to return it (for any reason, or for no reason), your only recourse will probably be to take him/her to Court. This will likely cost you more than $600, when all is said and done.
