I like Matt reply; carry them to the landfill. I wish I could. I can't even go in to protest for fear or reprisal. I received better in 1957-1959 when I was in the army.

No the other owner was not fined. If I get technical I have numerous complaints I could enter concerning dogs but I won't because I will not handicap a dog owner. I love dogs and though some folks do not read regulations or abide by them I will assist them with dog ownership.

The letter is vague in what authority is being used to fine me. At one place they state the violation details is as stated in the Cobb County Animal Control Documentation. There is no such document. Another place the letter reads: Per Article III, Section 3.24 of the association's by-laws. the Board has the right to impose fines or other sanctions for violations of the foregoing. Failure to comply shall be grounds for an action to recover sums due. Article III, has sections 3.2 but sub paragraphs are alphas, A,B,C,D. No section 3.24.

A member of the HOA board threatened to kill Rocky with one of his three guns and told me he was a very good shot and could kill us both. Nice guy and he has been on the board for 12 years.

I have not refused to pay. I intend to pay but I expect the board to provide me with truthful sources for their action.

I might remind the "official" that told you he was a good shot that you are a veteran who exercises his 2nd ammendment rights at all times...so he might want to mind his Ps and Qs.

No, really though, I would file a complaint with your police regarding the threat...at least it will be documented if anything happens to Rocky and others will know that he is a crazy SOB.

I am so sorry you are having to deal with such overzealous bafoons. I cannot stand HOAs for this reason. I had to pay a fine for a tumbleweed in my yard in Arizona while deployed in a war zone...they said I was vacationing and should have had someone remove the tumbleweed! I appealed, lost, then promptly sold the house and moved. I will never live in a neighborhood with an HOA again. For the record the director of the HOA who fined me while deployed and told me I was merely vacationing....his house burned down about 6 months later. Promise I didnt do it as I had moved out of state, but Karma is a b____! Couldn't have happened to a nicer guy.

midgeorgiaman could we send all the HOA board people to the middle east? I like the Karma. I guess Karma works both ways good and bad.

Homicidal threats are a felony in the State of Georgia. Successful prosecution is very unlikely in this case, as there is no evidence, aside from your word. I agree with midgeorgiaman, though. File a police report, and get it on the record. I would also have a concealed tape recorder handy at any time you may encounter him. If you get a threat on tape, he will likely become a convicted felon, which may preclude him from serving on the Board.

I have discussed some of my issues with an attorney. The attorney says "leave it, you cannot win". My wife says I should leave it also. I am a US citizen and veteran. The constitution says "All legislative powers herein granted shall be vested in a Congress of the United States”. I thought the US Constitution trumps all other law. But I am wrong.

The Cobb County Animal Control investigated a dog to dog aggression and stated that no harm was done and not citation issued. But the HOA president has fined me $100.00 and said the next time will be $500 to $1,000 or what ever amount he decides to fine me.

I need to talk with a constitutional lawyer. I am 78 years tomorrow and I don't believe our Constitution or laws are enacted to allow a HOA fine me when the County and City said no fault or fine.

I wish I could locate the folks who have moved due to the rulings of this board.
