Too bad he found another job, he had the perfect case for a lawsuit. Seriously, it's football people and not worth getting ridiculous over! The employer needs to put on the big boy pants.
This is not lawsuit material. Employers have a right to set a reasonable dress code. If the employer reasonably believes that wearing a Packers tie would offend customers, then the employee should take it off. If the employee had body odor, he can be sent home to clean up.
If just ONE prospective car buyer is offended by the tie, then the employee lost a potential sale, harming the business.
As flippant as it may sound, would his employer requested him to remove the item if it had some sort of religious significance such as a pendent of a holy cross, virgin mary etc? Probably not.
If not, how is asking him remove a clothing of item related to his favorite sports team any different?
Where exactly is the line drawn between someone's religious commitment and affiliation from someone's commitment in other spheres of their lives? Who has the authority to determine which is more significant than the other?
Employment law protects "classes" which include gender, race, religion, country of origin, etc. It does not protect favorite sports team.

I'm sure that there could be a wrongful termination cause found somewhere with this. I heard the guy was offered his job back, but refused it.
I could possibly see some sort of discipline, maybe, for not taking it off, but firing over a football tie? Most Bear fans at the store, when it comes right down to it, probably couldn't have cared less......the boss is a moron.
Wow, this "that might offend someone" thing in this country is getting completely out of hand. For crying out loud...it's a tie. It's not like it had naked women or swastikas on it or anything.
Where I work, we are allowed to jerseys if we want to on Fridays during football season. It increases morale.
From the story I read on, I think, CNN, he was told to remove the tie five times. Now, I think wearing a Packers tie is a dumb reason for a person to lose their job, but if you've been told by your boss to remove it five times already, maybe you should listen.
With the economy still being crap, it's not something I would have risked unemployment over.
