I've had "relations" while drunk with ladies who were also drunk. Apparently it all worked out.

What about a guy?

The first time I slept with my SO he was drunk and I was stone cold sober. Did I take advantage of him? I guess that's up to him. We've been together for two years, planning our marriage, and he hasn't gone to the authorities yet... :/

Seriously people, the most logical answer to any of those questions in the first post is
--common sense. Y'know, using your brain and stuff.
Being drunk is no excuse not to use common sense.


The likelihood of someone not intending to commit rape being actually charged with it is slim to nil.

I wonder if those who say that having sex with someone who is drunk is automatically and unequivocally rape have (a) ever been in a relationship with premarital sex (b) have ever been drunk?

Can you cite your source? I don't know the literature completely, but that doesn't sound correct.

BTW, at many colleges and universities, neither party can give "consent" if they are drunk (i.e. according to student codes of conduct). It can get very complicated very quickly.
