For me personally, a 'true' sex offender is an adult (21+) having sex with someone under 15. I would typically exempt an 18 year old high schooler who has fallen for a 14 year old - I've actually observed this kind of a relationship gap a lot back in my high school. Why should they be arrested? I mean, there should always be a "grey area" here. This 18 year old wouldn't be as bad as a 20 year old feasting on a 10 year old meat.

When I think of a pedophile I picture a 30 year old and a 10 year old. Now these kind of people should be punished, jailed and even banished from society. It bothers me when people see a relationship between, say, a 19 year old and 14 year old on that level, though.

If YOU were to make these laws (age of consent and the likes), how would they go?

NOTE: This thread is mainly to discuss pedophilia laws and statuary rape. Please no teacher on student sex posts, as there's already a thread on this.

You are right that when I was growing up and also when my mother was growing up what was acceptable was more lenient. Even if the laws were on the books ( not sure if they even were) nobody seemed to care if they were not followed.

Even today many parents do not mind if their teen girl dates an older young man as long as they approve of him. I guess they are thinking he would be a good match for her when she becomes and adult? I think to be safe and you may disagree if a boy of 18 wants to date a girl of 14 he may only do so if there is no sex. Keep it innocent. I guess there is no law against innocent dating ?

The best idea is stay away minors or get permission from the parents.
Most Sex Offenders got what they what is coming to them.
Some states have romeo and juliet's law to protect them.

Well, we need to be clear on what a pedophile is. An 18 year old (legal adult) having sexual attraction to a 14 year old (a minor) is not a pedophile. Pedophilia is the sexual attraction to prepubescent children, so arguably there isn't an age to which pedophilia becomes pedophilia, as puberty does not come at the same age for everyone. But it seems that 12 or 13 is generally the age at which people conducer it to be pedophilia.

I wouldn't say the laws are too strict or too lenient. It kind of depends on the situation. People charged with statutory rape (which is not pedophilia) are WAY to strict. Strict beyond the point of reason. However, I only recently heard a story about a man who adopted and raped a girl who was under 10 (she was either 6 or 9), who got 40 years, which I would say is sufficient. Then there are all kinds of issues in between where the sentences are too lenient or too extreme. I read an article a while back about a women who got 25 years in prison for having child porn on her computer; in other words, she got 5x the average prison time that a rapists gets for having downloaded pictures that someone else took and published. That, to me, is excessive. Five years in prison for something like that is more than reasonable (though that should depend on the content; pictures of kids frolicking on the beach is deserving a far less punishment than pictures of kids engaging in sexual acts; I obviously don't know what the pictures this woman had were of specifically, so maybe the picture were highly graphic and 25 years was sensible).

But I don't think the law on this issue is either lenient or strict. I think it just doesn't know what it's doing. The tough on crime policy has ruined us. We should have adopted a smart on crime policy, but that's not as popular with vindictive idiots who apparently make up a massive amount of the voting population.

Sex crimes as whole really need to be looked at on a case by case basis. Crimes involving pedophilia are no different. A child molester, pornographer, and rapist all need different sentences and punishment, despite their crimes all having a common theme. To assume a one size fits all punishment for such a diverse class of crime is not an effective way to deal with the issue.

And no person should be imprisoned or registered as a sex offender for statutory rape. That's complete and obvious BS. The only reason they get to call it 'rape' is because a minor can't legally consent, even if they agreed to whatever it was that happened. That's a situation where I think an 'age of consent' law is just government getting involved where it shouldn't be, but then what happens when child marriages start popping up because there is no age of consent? It's a tricky problem with no easy solution. All I know for sure is that what we're doing now is more of a feel good policy that a legitimate solution.
