I live in NC and my ex continued to file Motions to Modify child support (from an agreed order in 2001) due to his job loss - being fired. It was 4 years before we got into court and I had to forgo the full child support for most of that period - as he arbitrarily reduced the amount. Does anyone know if he should have had to pay it until the hearing versus being by law permitted to automatically reduce it from the date of filing the Motion? Seems to me the custodial parent should get the money until the court decides otherwise - versus the custodial parent having to make ends meet without it until the court decides othewise. Would a Motion for Contempt have made a difference at the time? At court he refused to go backwards and pay anything in arrearage and I was advised he didn't have to. Bad legal advice or bad law? Thank you!
