i bought this property 36 yrs ago with a 20 ft deeded right of way my neighbor who bought his land 12 yrs later had the land surveyed and didn,t search the deed filed a new deed and put my right of way against
my other neighbors property line my road does not run straight with the property line and my deed does not call for the neighbors line it reads in a north western direction on to my property also he has put a fence up from 5 ft to 3 ft in the right of waywhich cuts my right a way down to 15 ft also every time i grade my rd he calls the sheriff dept he also filled in the side ditch which casues the rd to erode in rainey weather i had a lawyer write him a letter telling him tomove the fences but he anored it when they ran the survey we told the surveyer that the rd didn,t follow the land line ps my deed is also grandfatrered under his by 11 yrs
what can be done about this problem he carried me to court a little over a year ago for tresspassing on my own right of way which the judge found me inocent eny body got eny answers thanks

Your attorney needs to handle this for you.

Just as a side note, please be careful. Land disputes often get people shot!

Yep, agreed. You need an attorney to file suit to correct his deed/ surveying job. IF, and that's an IF....that's all you sue for - the error of the other party...then a judge may order your attorney fees be paid.

But get an attorney as soon as you can.
