Are you sure he didn't discharge the gun? It would (obviously) retract the slide if he shot, or if he shot to slide lock.

However, we have to congratulate him for obeying one of the 4 rules of gun safety...always make sure the gun is unloaded before pointing it at someone. Maybe he will get 3 months instead of 6.

The guy doesn't look to be a career criminal letting the slide stay like that while actually pointing the gun. He'll probably wind up on tru tv's dumbest criminals.
Either way, these type of people need to be caught and sent away for a while if not indefinitely. Punishments need to be harsher like California's three strike rule. It will probably deter some from entering the criminal life or getting out of it.

The article didn't mention shots being fired or any injuries, so I just chalked it up as stupidity.

I bet you could talk him into looking down the barrel to make sure its loaded while he squeezes the trigger.
