I need help defending a report written up by an officer who found me at fault for a road accident last night. After stopping at the median and turning on my signal, I saw the road was completely clear on each side, no car in sight. I started to turn left and pull into a driveway and made it halfway through when some ****er came out of nowhere speeding like a bullet on a 30mph road and hit the rear end of my vehicle on the passenger side then fled. A person on the scene was interviewed by the officer and said she heard the collision and the other vehicle speeding away, but that was all. The officer on duty wrote me up and said that I contributed to the accident for turning without precaution. What...the... actual... ****?! I was on the median, road clear, and made it halfway through before the idiot sped along and hit me. And to top it off, fled the scene!! I talked to the officer and he's sticking to his initial report.

Now, are we not allowed to turn for under no circumstance just because an idiot might decide to show up out of nowhere as they often do, speeding down the road? What happens if making it halfway through your turn your battery dies on you and you're stuck. Do cars coming down a road not have the effing decency or responsibility to slow the hell down and stop??! You tell me what in the hell is the correct way to turn into a driveway?! I'm just flabbergasted. Am I missing something here? Cars coming down a straight road take priority over those turning, but to what limit? If there was no vehicle in sight and you've already started turning and even made it halfway through a driveway, to what limit do we give a vehicle coming down a road priority??! He could have turned from another corner for all the hell I know! Seriously, the mofo rules in this state kill me!!

I'll prefix this by saying that I'm not at all an expert but just taking a guess. The officer is issuing a ticket because you're the only one he can lay a hand on - and based on the damage alone would be a reasonable assumption.

The original car is likely at 100% fault for exceeding a reasonable speed for line of sight on that road. The only way you could fight the ticket is if an accident reconstruction would show the speeding car was X mph above the posted limit and the speeder wasn't visible at the start of the turn.

The guy who did the hit & run is likely an illegal, criminal, or was drunk / high and didn't even know he hit something.

In Russia, nearly every car runs a video cam for this reason.

I believe the officer probably made the correct call just based on the language you seemed to need and use to write this event. It says a lot about you, and guess what, character does still matter in some parts of the real world. Especially those parts dealing with responsibility.

Leaving the scene was entirely unforgiveable and probably was due to a personal reason; knowing that some other issue would arise due to this accident. That is another rant for another time.

I do believe you turned in front of this driver. People turn in front of me a lot, believing, I assume, that I will stop, swerve or do whatever is necessary to avoid an accident. I always find it fascinating that people will put their own safety and wellbeing in the hands of a stranger like that. That person you are so sure won't hit you may be drugged out, drunk or just tired of people who seem to think they can turn or do whatever they want, tough for you. I call that behavior entitlement.

Actually, when making a cross traffic turn, one is suppose to exercise considerable caution, and that includes knowing you have the right of way and time to turn, but not to make the many presumptions that you must have, because, after all, you did get hit.
