recless driving from an accident
my husband just totalled my car and got a recless driving ticket in the process. he wasnt speeding just lost controll on the highway and flipped it over the wall. we have suffered enough. do you think we should fight this ticket seeing as how he got hurt, we lost a car and no other car or person or property got hurt or damaged? please help

It can depend on his past driving record...might be able to get it reduced. You can get a reckless driving ticket while driving under the speed limit. Yes, hire an attorney

all thats on his record is one speeding ticket. not familiar with the out of state driving fine in the state or virginia. anyone know what it might be?

I was a witness to a similar accident. Guy was driving in front of me, lost control and rolled over. Totaled his car. He was cited for reckless driving as well. He went to court with a lawyer (Pete Decker III- I think) and it was reduced to improper driving. Hope that helps.

Why did the cops give him that ticket? Cops are bigger liars then politicians but I have to believe they had a real good reason to give him that ticket. Would they make it up based on the scene and what appears to have happened? Or did a witness stop and say he saw what happened and your husband was driving nuts.
Another angle is people by nature call anyone driving faster then them a maniac yet anyone driving slower then them are driving like $ht. That being said, some witness could have said he was driving like a maniac when in fact he was not.
Either way the facts are between the witness who told the cops what they saw or the cop who fabricated a probable story based on what he saw at the scene of the accident.
So that is your challenge. Do you want to pay thousands to a Lawyer to fight a couple hundred dollar ticket? I know it hurts to swallow it when you have been wronged but this is no longer a free country. Us peons are at the whim mercy of those who hold power yet are far inferior to us as human beings.

IMO, pay the ticket
As a driver, one has the legal obligation to maintain control of the vehicle they are driving. Your statement above does not indicate that there was a mechanical issue, or another car involved. It indicates that your husband failed to control the car - reckless driving that, could have, caused serious injuries or damage to others
Pay the ticket
I hope your husband recovers fully and soon

Well, if he pays the ticket, depending upon his record - he'll be hit with the Virginia Bad Driver "Fees".
That brings up the cost of the ticket another $1K - which might be easy for some to fork up..
But they're out of a car, he's got medical bills now, etc.
Personally, they need to have a technician try to determine if it was mechanical failure.

Who's going to pay for the tech? Your insurance comp? Might be cheaper if you have to pay for the tech. to just pay for the ticket.
