Here is my situation. My dad died last year. He owned a car free and clean and has the title in his name. The car is physically located in Hawaii County (big island). Title is HI.

My dad did not mention the car in his will.

Is there any way I can get the Hawaii county DMV to xfer the title to me? I have his death certificate. The DMV has no email addy and never answers the phone. I'm one of 3 children. Or does this require a court order from the probate judge? Can I just walk into the DMV with the car title and his death certificate and my ID and get the title xfered in my name somehow?

Fill out form 3C-E-312, get it notarized, and take to DMV with copy of death certificate.

Yes. Like mentioned below. Fill out the 3C-E-312 form. Get it notarized, and take to DMV with copy of death certificate.

Was the car included in the inventory of the will? No; were you the executor? How many executors were there and how were things split up? If you are the only beneficiary of the will than fine, but if there are others you need to let them know (legally). It doesn't matter if he said please take it, it has to be put in the inventory or addressed to the others in the will or if probate is over you need to inform the others...that would be the legal thing to do. You may or may not face these questions at the DMV. Are the others aware of this car? I will say no....so you need to tell them. There's usually some problems with the heirs post death and the probate process can be tough...the fair thing would be to sell the car and split it with the others or if they say go ahead well...congratulations. BTW; anyone can get a death cert...if proves nothing; only that he has passed
