I have a medication I have been on long time (Xanax) and they usually fill it 3 days early.....pharmacist knows me and their is a grace period for the monthly refill rule for some controlled medications. The issue is I am leaving on vacation ONE day earlier and would need to pick it up 4 days early, I'm in new York state, do you think they would allow/fill that for me? Pharmacy line is just busy all day.

Talk to your pharmacist they may be able to make the exception.

IANAL, but it would appear that the "grace period" is 7 days

where on page 71 it says:

"No additional dispensing of a controlled substance may be made by a practitioner to an ultimate user within 30 days of the date of the previous dispensing unless and until the ultimate user has exhausted all but a seven days' supply of that controlled substance previously dispensed."

Back in the day, when I worked at a pharmacy, there was a special code we entered when a person was going on vacation that allowed for an early refill.

Ask your pharmacist.

When I was practicing, I would not early fill controlled substances without a doctor's OK.

Legally, there is no such thing as "grace period"

I had the same situation and it was not an issue. I’m not in NY though and my insurance had to also approve it (along with doctor) before pharmacy would do it.

I believe the "grace period" she's talking about is an insurance thing. I do take some controlled substances, and insurance will only pay within 2 days of the prescription expiring. This makes it impossible for me to fill it via mail order, which would be a substantial savings. That is, unless I was willing to wail 8-10 days for it to be delivered We're talking about class 3 substances, nothing to get shook about.

If it is just the insurance company enforcing the 3 day rule, you may be able to refill early if you pay the full amount yourself.
