I broke my right tib-fib on Halloween in a motorcycle accident. I was rushed to a trauma hospital and required emergency surgery on the leg. The doctor put a rod and pins into my leg and I was in the hospital for 2 days. I returned home with a temporary brace and a week later went to the doctor. He said I did not need the brace anymore. So, for the next 2 1/2 weeks I kept my leg raised and only got up to use the bathroom with a walker. I went to the doctor 2 1/2 weeks later and he asked were my boot brace was.... I told him he never prescribed one for me. He didn't have much to say other than tell his nurse to get me a brace now. I did leave there with a boot brace that I must keep it on now. He is a well known doctor but it looks like an error has occured. He want me to return in three weeks for x-rays, and another visit. I need Help.. Did this doctor make an error? Am I going to pay for this error? The swelling has gone down a lot and my pain is not too bad. Is this doctor negligent for not giving me this brace right away. For 2 1/2 weeks I had no brace on it and slept without a brace. I know my leg was moving around and was very swollen, and extremely painful. It's been about 3 1/2 weeks now and all I do is sit on a couch with my leg raised. Do I need to look for another doctor, or think about an attorney?
Any input would be greatly appreciated.
