Somehow that roofer didn't flash the roof correctly around the skylights. REALLY makes me wonder how he's doing you a "favor." Maybe I'm dumb, but I'm with you, anything sticking out of the house has GOT to be made waterproof when a new roof goes in. I agree with getting a new roofer up there to see what's wrong, and fix it, and then you'll KNOW how the first roofer screwed it all up. Let us know what the new roofer says about the job the other guy did.
LIcensed, bonded or insured is ireelevant in most states. In a few states the license board might help you get his atention.
Insurance is for liablity, this is a breach of contract/warranty issue, not covered. If you have resulting damage or mold issues, it may be covered. It is worth a try anyway.
The problem is the amount of money involved is too small to be worht messing with. If your state requries a bond for a contractor's license, you could pursue the license bond, but it will cost you $20,000 to try to recover $2,000. The license bond companies fight like heck to avoid ever paying. There is a reason for this, but the explanation is too long.
The solution is to try to hire better contractors to begin with. That is not easy to do. There are not all that many who will step up to the plate when they make a mistake. Some will. However if they are really good businessmen, they are probably not running a company that does roof repairs on one single family home.
You rsoutions:
1. Contact the state contracotr's license board. In most states they will not do anything. They have no funding. In many states there is no enforcement agency at all. In most places licensing only means the person wa able to pass a test that mostly covers issues you do not care about.
2. Call the BBB. Again this may or may not accomplish anything.
3. Check on Angies list or other referral services, see if you cna leave a negative report.
4. File a claim in small claims court. This is a pia and will eat up a lot of time, but sometimes you cna actually recover on a small claim and collect the resulting judgement. Get a book form the law library with step by step instructions.
5. Have or make a friends who is a lawyer. Have them send a letter on their letterhead. Often that is all it takes to get a contractor to make your issue a prioirty.
No matter what you do, it is not a good idea to continue waiting while ran comes into your home and does more damage and potentially starts mold growth. See if you cna find a more reputable roofing company and have them come fix the problem. Also have htem look over the job and see whether there are other problems.
Sometimes you just have to swallow the losses. I am a construciotn lawyer and I still got taken by some bad contractors. One guy sprayed insulation all over the ground and only made it look like he put some in the walls. By the time I found out some walls had no insulation at all, he was out of business and long gone. What can I do? Hire someone else or do the work myself. Sometimes you just get ripped off and you get to pay again.
Contact DPOR in your state. Dept. of Professional and Occupational Regulation. They got the roofer that messed my roof off his butt.
