My cousin got arrested SuperBowl night for DWI. He says that he doesn't remember anything but that a witness told him that he got out of the handcuffs and HPD started to beat him up so bad that he ended up in the hospital.

Can he press charges?

He was driving yet he doesn't even remember getting beat up by the cops? That doesn't sound good.

He got out of the handcuffs; was he resisting arrest?? If he was than the HPD got a pretty good case against your cousin. Mix that in with drinking and driving; not a good look.

I'm not sure if he was resisting arrest but by getting out of the handcuffs I am assuming that he was. But would that give HPD the right to beat you up so bad that he ends up the hospital?

How badly is he beaten??? Just because he's in the hospital doesn't mean it's that bad. Does he got broken/bruised ribs, black eye, etc???

Yes only one witness. But I am very skeptical about my cousin because sometimes he gets in fights with his own brother just because they get drunk. His brother was there with him and nothing happened to him.

His bro, doesn't remember anything either.

Oh and one more detail, the cops didn't take him to jail for DWI. They just dropped him off at the hospital.
